"The government is preparing to appeal a High Court decision that branded its plans to rush through cuts to solar tariff payments as "legally flawed", leaving the industry in the dark over the current level of incentives for new solar installations.

The Department of Energy and Climate Change (DECC) will tomorrow file an appeal against last month's ruling by Mr Justice Mitting, who said it would be illegal for the government's proposed cuts to have an "effective date" of 12 December, two weeks before the consultation officially ended on 23 December..................."

What will that achieve, I thought the number of installs had dropped right off, so financially there seems little point in playing games. Just announce a new date 2 weeks from now. Unless of course they have to give 6 weeks notice or more again, and fear another FITs rush?

The bizarre point is that the entire £867million FiTs 'budget' has already been allocated based on the potential generation (for the next 3 years) from systems that have been registered. If that 'budget' is truly fixed then DECC have no choice but to close the scheme immediately to any new entrants as there are no funds left.
